Introduction
- IvySMS realises that privacy is key and important when it comes to communication over the internet. Security technologies for internet communication is very sophisticated now which means communication is safe and secure over internet. IvySMS Privacy Policy is to assure users of its service that any information provided including personal information are safe and secure using this service. We comply and align with regulation and legal requirements for data protection.
- Where used in this policy, the term "personal information" means any information identifying or describing an identifiable individual, including, but not limited to information relating to their name, full business contact address, title in the organisation, responsibility in the organisation, contact email, business contact telephone number, business contact mobile number, business website information, industry of business operation, size of the business (in terms of number of employees), the extent of their spread (number of countries they operate in). “User” as used in the context of this privacy statement refers to the entity that registered to use the services provided by IvySMS’s SMS Gateway platform.
Commitment to Privacy
- IvySMS is committed to maintaining the confidentiality, integrity and security of personal information of our users and we take all appropriate technical and organisational security measures to ensure that where any personal information is provided to be able to use the service is protected against loss, destruction and damage, and against unauthorised or accidental access, processing, erasure, transfer, use, modification, disclosure or other misuse.
- We do not disclose to any person any personal or non-personal data of a subject that is processed or hosted through the platform; where any such disclosure would not comply in all respects with the provisions of any applicable data protection legislation or regulations relating to the data subject concerned.
- A user's contact list and MSISDNs indicating to whom messages were sent to or received from belong exclusively to that user and will not be disclosed to any third parties without the user's written permission or unless compelled to do so by a court of law. The user has absolute control over and responsibility for message sent over the platform. IvySMS is indemnified of the content of the message sent through its Gateway.
- Any recipient of any message has the right to know the identity of the sender. In case sender identity is concealed, this will be disclosed on request to the recipient if that situation arises in alignment with legal requirements.
- It will be required of users to submit limited personal information when accessing the services after initial registration including a username, email address and password for the purposes of protecting user accounts against unauthorized access.
- We may automatically record certain information about the use of our services such as account activity (e.g. usage, log-ins, actions taken, payments), data displayed or clicked on (e.g. GUI elements, links), and other log information (e.g. browser type, IP address, date and time of access).
- The system uses this information to provide user’s authorized persons with usage reports and status to deliver the best possible service assurance to users.
- We may also detect and log a user's location and IP address in order to identify the User’s geographic region or time zone for routing traffic to geographically based servers or for managing time-sensitive tasks like the sending of notifications.
- As characteristic of online operation and Like many reputable online companies, our services, including our website, other online services, applications, email messages and advertisements, if any, may use "cookies" and other technologies such as pixel tags and web beacons to collect information. A cookie is a small data file stored on the web browser on your computer's hard drive. Cookies and other technologies make it possible to count how many users visited certain web pages within our web site, their personal preferences and to measure the effectiveness of our website and electronic advertisements for different computing devices and regions.
- Information so gathered are useful to understand trends and patterns, which helps to further understand user behaviour, preferences, how services are being utilised, identify usage patterns, market trends, gain insights. The information helps to formulate new products and service offerings, administer the website to improve service(s). If a user blocks cookie from being stored on a computer, the functionality of our Services may be negatively affected.
API's and Third-Party Processing
- For the purpose of providing the Services to our customers, the gateway platform deploys Application Programming Interface ("API") to make different software systems work together to provide end to end service. IvySMS APIs also interacts with third party APIs. For example, third party application developers requiring SMS integration in their product may interface with IvySMS Gateway platform to send and receive SMS. This in no way impacts individual enterprise user of the platform and their information or data.
- Where we make use of third-party service providers to help us provide services to you, for example Mobile Network Operators (MNO otherwise known as Carriers, such third parties maintain the confidentiality of any information we provide to them for these purposes. Some of these third parties may be situated outside of your country, for example sending SMS to a recipient in another country. You consent to your personal data and that of any data subjects you provide to us being transferred cross-border so that we can provide the services to you. In this regard, for your security and rest of mind, we engage only with reputed third-party service providers who have security and privacy policies and procedures providing at least the same level of protection as we do ourselves. You warrant that you have all necessary permissions to give us the above consent.
- Third-party service providers or consultants who have the responsibility for system maintenance are limited to only accessing or using relevant data to provide such services. They provide reasonable assurances that they will appropriately safeguard the users’ data. We may also share non-personal or non-identifiable information, including website visitor information (traffic) and account usage data with third party analytics service providers.
Communications with You
- There are situations whereby we may communicate with users, resellers and other persons by email and other messaging applications. It will be possible to opt out of any promotional communications from us that are not strictly related to the provision of main services to you.
Personal Information of Minors
- It is not expected minors will use this service as it is an enterprise, business tool. We make clear that we do not intentionally collect personal identifiable information from anyone who is a minor. If it is discovered that we have unintentionally collected personally identifiable information from a minor other than for a legitimate purpose associated with the services, we will delete that information immediately.
Revisions and Termination
- As it is with any services, our Privacy Policy may be updated from time to time at our discretion and changes will become effective upon posting to the site. Other reasons will be if regulation and legal requirements from authorities change, we are bound to be aligned to that, hence review our privacy statements accordingly.
- If IvySMS merges with, or is acquired by any other business, you acknowledge that your personal information may fall under the control of another entity. However, it is expected that the standard of privacy for this service will be maintained as required by law and regulation.
- If you terminate your relationship with IvySMS, portions of your personal information may be retained in back-ups and archives for as long as is reasonably necessary to assist us in meeting our legal compliance obligations.
